Terms and Conditions for Delicate Dreams as ‘the Supplier’ to you ‘the Customer’
Applicable Peoples
A. These conditions are applicable to all sales from Delicate Dreams. Once payment has been received, the Supplier will confirm that the order has been accepted by sending an e-mail of confirmation to the e-mail address provided by the Customer at the time of your order. This e-mail will form a legally binding contract between the Customer and the Supplier.
B. Supplier is not responsible for the consequences of faulty or inaccurate receipt of information, orders and/or agreements by reason of the failure of the means of communication used.
Prices
A. All quoted prices are, unless expressly mentioned otherwise, in GBP where the goods are stored.
B. The Customer will be required to pay extra for delivery, as per on our website www.delicatedreams.co.uk
Liability
A. The supplier shall not be liable for damages as a result of the supply of goods under this agreement, including where third parties suffer damages caused by or originated in connection with goods supplied to the Customer by the Supplier. The Customer is obliged to hold the supplier harmless from all liabilities of third parties concerned.
B. If goods are not received with 14 days of the date on which the order was placed, the Supplier shall have no liability unless the Supplier is notified in writing at the address provided within 30 days of the order being placed.
C. In this instance and under this condition, the Supplier will, at it’s option either:
i) Make good any shortage or non-delivery
ii) Replace or repair any goods that are damaged or defective
iii) Refund the amount paid by you for the goods in question.
D. Guarantees about colour fastness, waterproofness, washability, shrinkage and other technical qualities and possible exclusivity are only operative when these are confirmed by supplier in writing or by means of labels or otherwise notified on the goods.
Force Majeure
The Supplier has no liability to the Customer for any failure to deliver any ordered goods or any delay in delivery or for any damage or defect to goods delivered that is caused by any circumstance that is beyond reasonable control.
Authorised Rights
A) For all agreements with the Supplier, or agreements originating from those, as well as these terms and conditions of sale, supply, and payment English law is applicable and the English courts shall have jurisdiction over any dispute arising between the Customer and the Supplier.
B) Nothing said by any person on behalf of the Supplier should be understood as a variation of these terms and conditions , or as an authorised representation regarding the quality and nature of items offered for sale by the Supplier. The Supplier shall have no liability for any such representation being untrue or misleading.
Sytem Misuse
Any attempts to enter into any secured area of www.delicatedreams.co.uk without authorisation. Delicate Dreams reserves the right to report such illegal activities to any and all-regulatory, administrative and/or governmental authorities for appropriate prosecution.
